Resolutions to Affirm State Sovereignty may be Prelude to Secession

Nine state legislatures have either passed or introduced bills intended to reaffirm their state's sovereignty as laid out in the Ninth and Tenth Amendments of the Constitution. Another twenty states are expected to introduce similar measures this year. While the ramifications of these resolutions are still uncertain, one thing is clear. People are sick and tired of the federal government's usurpation of power not granted to it by the Constitution. They have had enough of fear based economic terrorism and underhanded promotion of policies and procedures that bypass public scrutiny and the will of the people.

Hearing that the Obama administration is pushing for immediate passage of the nearly $1 trillion deficit spending plan without allowing time for legislators to read the 1400 page document may be the last straw. Some who have read parts of the package have found it to be slanted toward more Democratic-supported social welfare programs, as well as laying the groundwork for sweeping health care reform that should be subject to scrutiny and debate by the people.

It is time to resurrect the Tenth Amendment

The Constitution applies to the federal government. Its sole purpose is to spell out what the federal government can do. Today, even the most casual review of federal government activities makes it clear there is very little that it does which is actually authorized by the Constitution.
The Tenth Amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." It means that the federal government is authorized to exercise only those powers which are specifically given to it in the Constitution.

The Tenth Amendment is despised by those who suck the mother's milk of big government because it was drafted to enshrine in the Constitution what the founders and the original states had learned from experience, that small, limited government is the best government.

Hard to say what is in the minds of State Legislaters

since an open call for secession might get them arrested by federal authorities under one of Bush's terrorism statutes.

After all, they are mostly ordinary Republicans and Democrats. They may just be responding to pressure from a few of the people they represent or perhaps they do think the federal government has overstepped its bounds and just want to make a public, innocuous statement which they think will be popular among voters in their state.

Whatever their motivation, I seriously doubt than the great majority of those sponsoring or voting for these bills would even consider secession. Look at how they screwed with the NH bill, and isn't that the "Live free or die" state.

The Federal goverment needs to be abolished

Lets keep the bill of rights and abolish the rest of federal government in accordance with the Declaration of independence.
That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn that mankind are more disposed to suffer, while evils are sufferable than to right themselves by abolishing the forms to which they are accustomed.

Keep in mind that

Keep in mind that reasserting sovereignty does not mean secession-- however it is the origin of the right to secede. Let us also not forget that there is another option which comes with sovereignty-- nullification. They are a 3 piece set!

My first piece of advice would be to wield nullification before I'd go advocating secession. If that road does not work then there is always the alternative. Secession should have never been removed from the table but it must be held with a cautious hand. I believe that we should form a huge coalition of states (more than half) before any motion of secession should be issued. If that is achieved then the Federal government would be hard pressed to rally enough troops (since our military is composed of citizens from many of the sovereign states in question).

HI, This morning I called my

This morning I called my rep, Leo Berman, and requested that Texas follow the other 21 states and draft a resolution explaining to the feds that we have a 10th amendment to our constitution which they must obey. Any unconstitutional laws will be DOA in Texas.

The staffer called me back just after lunch and said the the congressman was drafting just such a resolution this very afternoon.

I hoped that everyone would help to further this by calling their reps to support the resolution. The staffer said that our statehouse is chockful of rinos and that it might not go very far without a push from the citizens.

This afternoon I received this note from the congressman:

There will actually be 2 Concurrent Resolutions each worded a bit differently. Mine will be filed next week. Today, HCR 50 was filed. I just signed on as a joint author.

Look for U.S. and NATO troops to take over

The sabre-rattling by the states to assert their rights will not work in the long run. There is too much money at stake and the Federal government is ruthless, if nothing else. If a state dared try to seceed from the Republic, the Feds would declare martial law in that state and send in soldiers, "for the protection of the citizens."

A possible, workable, scenario is that if 20 states could synchronize their efforts, so they all withdrew together, or something similar, then the FED would be pretty much powerless. But, one at a time, each individual state would be crushed eventually. No state has enough of a militia or standing army to oppose U.S. forces, esp if they are reinforced with NATO soldiers.

We may be looking at another Civil War down the road, and it won't be pretty.

If a state were to secede from the union and if the Feds tried to enforce unity by declaring martial law... that would really be the end as we know it. For myself, I just cannot believe the US military would fire on American citizens on US soil. The officers might give the orders but I refuse to believe the soldiers would carry them out. IMO, the Feds will keep the states from straying by sending them bailout money. Most states are bankrupt and facing shortfalls which would end the illusion of the state "government powerbroker" lifestyle. Before the politicos give up their phony bigwig lifestyle they'll kneel down before the Feds. These resolutions are just saber rattling to get at the head of the line when the loot gets divvied up.

all the states active in this ... their leaders need to start having meetings behind closed doors. the fed is a nasty beast and it ain't gonna give up easily. it will fight to the death.

Because the Southern States seceded from the union, Lincoln and Co. were able to pass all those horrible laws in the 1860s. With no opposition from the states that still believed in Jeffersonian ideals (the Southern States), Lincoln was able to pretty much give the Tenth Amendment a dirt nap. Up to that time, for eighty years the Jeffersonians held the Hamiltonians in check to a large degree. After the Southern States seceded the Hamiltonians ran amok, and the Jeffersonians perished.

Not saying that the Southern States did not have the right to secede, or that they should not have exercised it, but they were the only ones truly guarding the hen house against the foxes (in the District of Corruption).

Interesting now that the States are rediscovering the Tenth Amendment. It's like an episode of CSI or Bones, where the body is being exhumed. I'll bet Lincoln thought we'd never find it.

...that over-reaching pushes are always tactically poor judgment. I think however that used in this sense it is more of a response probe. Same thing that is being done with lots of the talking heads spouting out information that might be shocking to the sheep, but an "it's about time" moment to those who have done a bit of research. It's a big game, and not one thing "announced" in the public venue has only one sole relationship to future outcomes.

But yes a gut-reactionary phrase used overly casual can be a very poor implementation of selling real freedom ideas to the masses.
