
New gun law aimed at asserting sovereignty

Gov. Brian Schweitzer has signed into law a bill that aims to exempt Montana-made guns from federal regulation, adding firepower to a battery of legislative efforts to assert states’ rights across the nation.
“It’s a gun bill, but it’s another way of demonstrating the sovereignty of the state of Montana,” Democrat Schweitzer said.
Since the law applies only to those guns that are made and kept in Montana, its impact is limited. The state is home to just a handful of specialty gun makers, known for recreating rifles used to settle the West, and most of their customers are out-of-state.
But supporters of the new law hope it triggers a court case testing the legal basis for federal rules governing gun sales.
“What we need here is for Montana to be able to handle Montana’s business and affairs,” bill sponsor Rep. Joel Boniek, a Republican and wilderness guide from Livingston, told fellow lawmakers during the bill’s House debate.
The measure is one of many introduced by state lawmakers across the nation seeking to confront what some see as a federal overreach into state matters that will be extended with the national stimulus plan.
Along with the gun bill, Montana legislators are considering a resolution that affirms the 10th Amendment principle that the federal government only has those powers that are specifically given to it by the U.S. Constitution.

Montana just saved thier economy! When they see how the gun business will boom they will pass laws exempting themselves from other federal BS regulation Way to go Montana!
As other States see Montana prosper hopfully they will follow suite. The feds will try and nip this in the bud so be prepared and stand tall Montana your neighbors in Idaho are watching!!
By the way what part of Montana is the banana belt I might have to look at some property up there!

The centralization of power in this country is sickening. It used to be that the dissolution of guns AWAY from the capitol and in every private home ensured that a tyrannical government couldn't get away with what they did in places like Louisiana after Katrina.
Now it's the EXCEPTION to own a gun, and people have to claim "target shooting" or "hunting" in order to own a firearm. Everyone should have a right to bear REAL arms. Obviously there are some limits, but this "omg no assault rifles" garbage has got to go.

GOOD NEWS! Governor Schweitzer signed HB 246, MSSA's Montana-made
guns bill, today. HB 246 declares that any guns and ammunition made
and retained in Montana are not subject to ANY federal regulation
under the authority of Congress to regulate commerce "among the states."
HB 246 will become effective on October 1, 2009. MSSA is beginning
now to plan our legal strategy for vetting the legal principles
involved. Soon after October 1st, MSSA will determine if it is
necessary to file a lawsuit in federal court to prove the principles
established in HB 246. If we do need to file this lawsuit (probably
will), MSSA will need to do some serious fundraising to defray the
expenses involved.
Meanwhile, we firmly recommend that no Montanans begin making the
proposed Montana-made guns until we are able to vet the legal
principles. We do not want any Montanan to become subject to
possible federal criminal charges until the legal issues associated
with HB 246 are resolved.
