Internet purchases soon to include SALES TAX

If a little-known but influential alliance of state politicians, large retailers, and tax collectors have their way, the days of tax-free Internet shopping may be nearly over.

A bill expected to be introduced in the U.S. Congress as early as Monday would rewrite the ground rules for mail order and Internet sales by eliminating what its supporters view as a "loophole" that, in many cases, allows Americans to shop over the Internet without paying sales taxes.

“We will have the bill ready for introduction by next Monday,” said Neal Osten of the National Conference of State Legislatures. “We finalized the language and now we’re working out the remaining issues and adding some new provisions at the request of various stakeholders.”

The final legislation is expected to be introduced by Rep. Bill Delahunt, a Massachusetts Democrat, who has championed similar proposals in the past. Delahunt’s office on Wednesday confirmed he was interested.

President Obama is a strong ally of the new tax laws and is expected to sign them into law. Internet companies like Amazon.com, eBay and Google are outraged. Until now, they have remained recession proof by offering products at lower prices than comparable brick and mortar stores.

NYS already forced sales tax on internet sales. Thats the main reason I stopped shopping at amazon.com

It's bad enough that sales tax here is 8.75%, but now they are adding a 5 cent deposit fee on every single bottle of water purchased.

while there may be a federal loophole, there aren't many state loopholes.

it is within congress's authority to regulate interstate commerce for the purposes of facilitating state collection of their constitutionally authorized sales tax. i don't care for taxes, but states have to get their money somehow. i'd rather it be sales taxes than income and ad valorem taxes.

Well look at this way.

Ebay has made sellers accept only Pay Pal from buyers.
The credit card company already sends a yearly break down of purchases in groups.
So, It is possible that when credit/debit cards are used and sales tax has not been charged, you will just get something once a year saying that you made these purchases and you owe this tax OR the tax could be applied when you make a purchase with the card, cutting out the middle man.

If they have the power to tax at 1%, then they have the power to tax at 100%, but they are smart enough not to make it one tax.

We still accept money orders.

Ebay has removed the part where you can broadcast you accept money orders or checks...but you still can and we still do.

On the Louisiana state

income tax return you are asked to calculate the tax on internet and catalog purchases and add it to your return. So far I haven't complied but it may be unavoidable in the future.

How?

How would they tax it? I mean, local businesses get taxed locally...even ebay in state you have to charge in state taxes. How would it work for interstate transactions?

Also, can someone cite where ebay is going to have to be reported to the IRS?

For all you Ebay sellers

Starting next year you have to pay the IRS as income from all of your sales. I'm done selling on Ebay for this very reason. I will stay locally, until Craigslist starts turning me in to the IRS that is.

Are you sure this is starting next year?

I thought it might already be in place. Does that mean THIS year's sales will have to be reported as income on NEXT year's tax return? Or the year after that? Do you have any more info on this? Thanks.

Don't worry about it! The paper work reduction act clearly states that we do not have to fill out any government paperwork if it does not have a 'current' OMB number on it. The OMB numbers on both the 10-40's and 10-99's expired a year or so back. they have not been renewed. You did not have to file tax's this year.....I am writing to the Attorney General and Infernal Rip off Service for clarification. It will be interesting to get their reply's, if any.

Just did a little research on this...

Turns out this eBay/IRS policy doesn't go into effect until 2011. And it only applies if an eBay seller does MORE than $20,000 in business AND at least 200 PayPal transactions. The little guys are still relatively safe - for now...

Violates the Interstate commerce clause

It seems to me this bill would violate the Constitution's interstate commerce clause which makes things like charging levies or taxes on people in one state more than another. If this bill passed Company A would be charging people in different states different amounts. The only reason companies currently have to charge sales tax is when they are doing business in a specific state and are thus bound to charge locals the sales tax.

Every state AFAIK that charges sales tax also has a USE tax that is the same amount as the sales tax and is a charge for bringing things into the state from somewhere else to use in that state. So everyone who lives in a sales tax state should already be paying their state's use tax on everything purchased, but most everyone doesn't do this because its voluntary and the public is not sufficiently aware of their obligation.

So does the recently signed into law Montana Gun Sovereignty...

It reminds me of the song "Tax Man" by the Beatles. Everything, everything will be taxed. It does anger me a lot. Internet sales have been a wonderful haven and still should be. How criminal.

Ebay might "claim" to be "enraged", but Ebay is a toadie for the Federal Gov't, and is happy to institute as many onerous policies as humanly possible against their customers.

I have to strongly disagree

Myself, along with millions of others, have lived for 8 out of 10 years with eBay being my sole income (the remaining 2 years eBay accounts for 60+%). I may not like eBay, their fees, or 100% of their policies, but it's brought food to the table for the last decade. Who knows that the future brings for eBay, but for me, I'm thankful for all of the years that they've provided in the past.

Don't get me wrong...

...I've been on eBay for almost 10 years, as well. But the last straw(s) for me was when they decided to dictate which forms of payment sellers could (or could not) accept AND stopped sellers from being able to leave negative feedback for bad buyers. I don't need anybody - the gov't, eBay, etc. - dictating how I run my business. I know there's still money to be made there, but the price is now too high - for me, at least....

If Ebay were gone

better options would exist, from upcoming competition.
Ebay is a monolithic giant which has totally lost its way, if it ever knew anything to begin with.

With Ebay out of the way, real companies that knew how to serve their customer base would take the place, and would be much preferred to some massive bureaucracy that dictates to its customers instead of serving them.

They were in the right place at the right time, and became giant because of it. And they showed what they were made of, and it is NOT pretty.
