The stress test are for the banks to establish a minimum amount of cash on hand. In most contracts does it not suggest that if the bank needs money it can call all loans due. Say your house is worth 200k you owe 50k so the bank calls your loan due even thu you have never missed a payment . You can not get a 50k loan because of the credit crunch. They forclose and sell your house keeping the 200k . All loans cars ect.,, Todays news paper had 18 pages of forclousures and 2 pages of minimum wage jobs. Its all about putting as many people in debt and keeping them there.

I studied this issue a number of years ago. I learned of this when I attended a law school for lay people called The Barrister's Inn School of Common Law. That school might still be around. The theory was that since Federal Reserve Notes are not money, but in reality an IOU, you can never really pay anything off with them. It's like a check. Say a check gets endorsed repeatedly from person to person to person but then the check turns out to be bad. Each person down the line can be held liable jointly or severally. Why do you think they make everyone endorse the check? Having learned this, when I paid off my mortgage I made a note on the check "Without Recourse". So by cashing my check they surrendered their right to come after my property if the Federal Reserve Notes I paid with turned out to be fiat. If the country really has been in bankruptcy since the nineteen thirties, then in theory, any bank can seize any property that was used as collateral against the IOU's, FRN's.

Foreclosure for any reason
Unrelated to this particular case, last time I looked at mortgage papers, they listed "failure to maintain property" as cause for foreclosure.
Thus, if a bank gets "stressed", it'll just start inspecting properties to see which are the least maintained and start foreclosing those, as those have the greatest chance of holding up in court.

The lender would have to still go through the process of foreclosure.. While the process is different in each state, you would always have the ability to go to court to stop it, and before you could ever be evicted by a sheriff, the lender would have to get a court order to do so...
"Calling a Loan"
The lender can not "call the loan" on a home mortgage. The only way they could obtain the property is through foreclosure process if she wasn't making payments... Something's not right here.
Furthermore
She couldn't just have "ignored" the mail and this happen, because before the lender can foreclose, they must use a whole host of procedures including certified mail, etc. If she really had a case, this would have been simple to stop the foreclosure through court filings, the courts if they agreed with her, would have not allowed the bank to take posession.
The sherrif would not have become involved unless the courts mandated an eviction, which happens MINIMUM 30 days AFTER the property has transferred ownership.

Here's my problem with this: Where's the evidence she paid off her mortgage? It's pretty easy to scan a letter and show everyone online. This should have been priority number one way before she called into the show.
Number two- joyce is fuzzy on the details. She said the woman got behind on her payments, but her loan was paid off-so what is it? paid off or not?
If she had her loan paid off then give us some evidence. If she didn't then the sheriff did his job.
Also I don't know what happened between Joyce and Dave Von Kleist but he hasn't been on the power hour for weeks. I used to listen to their show and noticed Joyce always interrupted with snide remarks and cut Dave off. When its just her on she takes calls seriously from wackos who don't have any evidence.

Places where the county sheriff favors an international bank over his county residents. I am close to 100% sure this would NEVER happen in my county 1) My SHERIFF doesn't even have a SWAT team because 2) he's pretty sure his fellow residents have his back. 3) there is only one "big" bank in my county - most people use local banks and S&L's. 4)my neighbors would not allow it (-they'd probably write the check ( I would)There are places where a relatively high degree of freedom is possible freedom and responsibility are inextricably linked..

That's not true
The bank can not simply "call in" your loan and take your home. Nowhere in the 18 inch thick pile of paperwork describes such a situation, and it would be breech of contract if it were to occur.
The stress tests don't compel the banks to go repossessing every house that has value...they can simply convert the government's stake in them to common shares, or sell off their stock to raise capital.

Paperwork mistakes occur, to err is human and it's entirely possible that a bank might make this mistake.
This person's mistake (most likely) was ignoring mail and attempts by the bank to contact them...they figured they didn't have a mortgage and didn't owe the bank a moment of their time.
Lesson learned...when a bank asks to talk to you, it's probably in your best interest to return a phone call and clear up an error, rather than barricading yourself in the home.

She had gone to court previously and showed a judge the mortgage was paid in full, and it is a record of the court. However, these are desperate times for Wachovia who continued to threaten the 54-year-old woman.
These paperwork problems aren't uncommon. In fact many people wind up in court after they are told they owe more money on their homes after a series of mortgages being pushed back and forth through the mortgage process.
Wachovia Mortgage took over the mortgage and said they weren't going to honor the paperwork from the previous mortgage and continued to harass this woman. So we have a woman with the proper papers showing her house is paid off with the police and the courts ignoring the paperwork according to the story.

She probably thought the letters from the bank were credit card offers and tossed them. I get them all the time and they say urgent response required etc. She obviously disputed it. This a civil court matter not a swat team criminal raid on a crack house. The bank needs to prove thier case before they foreclose and what was the need for the swat team?

This is a story that broke on the Power Hour today. I actually heard it first on "The Alex Jones Show" this morning.
Dawn Welsh believed that she owned her house free and clear. As is the practice in the mortgage industry, companies buy and sell equity instruments in connection with real estate. In this case, Wachovia alleges that Ms. Welsh never fully paid off one of these equity instruments and therefore, it must foreclose and reclaim the property. This morning the Jefferson County Sheriff's Office raided and arrested Ms. Welsh.
I guess it is okay for bankers to take trillions offshore, but if there is a dispute over a $125,000 home in Middle America, then we need to bust down doors and send in the S.W.A.T.

I have a friend who had their mortgage go from 900 dollars a month to 1900 dollars a month. The bank over paid the taxes in 2007 and these people have tried and tried to get the matter straightened out. It is NUTS.
