Ron Paul's Protect Patients' and Physicians' Privacy Act

This legislation introduced by Ron Paul today is something I think we should get behind. I don't like the idea that my private medical records could be available to the federal government and who knows who else.

Statement Introducing the Protect Patients' and Physicians' Privacy Act

"Madam Speaker, I rise to introduce the Protect Patients’ and Physicians’ Privacy Act. This legislation protects medical privacy, as well as quality health care, by allowing patients and physicians to opt out of any federally mandated, created, or funded electronic medical records system. The bill also repeals the sections of federal law establishing a “unique health identifier” and requires patient consent before any electronic medical records can be released to a third party."

We need to "HR1207" our congress critters on this

I totally agree about HIPPA. If you really read it, it basically says everybody can have your medical information anyway. And also report you as a "statistic" for cash. So this new mandate, to me is just a way of saying, "We're watching you and you better know it!"

I have philosophical differences with any doctor who "turns in" a patient for anything but true crime. Getting "turned in" by doctors has become rampant in upstate SC. That is just the weirdest thing to me.

Anybody here remember Doc Baker from "Little House"? Whatever happened to that kind of doctorin'?

I called our local "Ask a Nurse" (stated funded county hospital) line the other night when Dad was worried about both his arms tingling. It's is supposed to be merely a "help" line to answer questions, not a 911 type thing, the service notates it is not an emergency line. My Dad had only been gone from this particular hospital a day or so when I called though so it was important.

Ms. Ask a Nurse wanted to know my name and d.o.b. and then my father's name and birth. I told her I was not the patient and she told me that she needed my name and birthdate for "medical records". I'm thinking, why does she need anything but my name to communicate? I stammered and consented because of my Dad and she starts reading off my address and asks for confirmation. I'm like, this is not an emergency call yadda yadda why do you need to know all this about the "non-patient caller". Of course it was just her job so when we were about to hang up, I told her I was sorry if I was ill-tempered with her but she needed to understand that in the stimulus package, a mandate was passed to seize all citizen's medical records and she would probably get a lot more complaints. She was strangely unaffected --

Recently, when I went to my family doctor, they asked that I bring a photo ID so that they could enter it into the new government electronic system. I just so happened to forget my photo ID.

Last month I received a letter regarding HIPAA, from my healthcare provider. It read: "This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review carefully."

Here are some excerpts from this letter.....

The Plan may use and disclose your PHI to others so that the Plan can facilitate proper payment and treatment.

The Plan may disclose your PHI to business associates of the Plan.

The Plan may use and disclose your PHI to your employer.

The Plan may release your PHI to either a family member or someone involved in your healthcare.

"The following are examples when the Plan may disclose your PHI without your authorization (this list is not exhaustive and there may be other situations when it would be necessary to disclose PHI that are not addressed here):"

Required by law

Victims of abuse, neglect, or domestic violence

To avert a serious threat to health and safety

Health oversight activities

Judicial proceedings, lawsuits and disputes

Law enforcement

National security and intelligence activities

Military and veterans

Inmates
